1. Rental Agreement:
By renting a scooter from the Running Late Club (hereinafter referred to as “RLC”), the hirer agrees to the terms and conditions outlined in this agreement. Please read them carefully before proceeding with your rental.
2. Rental Eligibility:
The hirer must be at least 18 years old and be in possession of a valid motorcycle or scooter license, acceptable by South African authorities, for the duration of the rental term/period.
3. Rental Period:
The rental period begins at the time of pick-up and ends at the agreed upon return time. Late returns will result in additional charges.
• Collection/drop-off address: Two Forty Two, 2 Ravenscraig, Green Point, Cape Town;
• Hours: Between 7am and 2.42pm (Tuesdays to Saturdays), or as arranged with RLC at the time of collection of the Scooter.
• The period of rental of this scooter shall be agreed upon on signature of this agreement and any late delivery will result in a charge of R40.00 (Forty Rand) per hour. There will be a lost key charge of R200.00 (Two Hundred Rand) and a lost helmet charge of R600.00 (Six Hundred Rand) exclusive of collection/delivery.
4. Reservation and Cancellation:
Reservations are recommended to guarantee scooter availability. Cancellations must be made at least 24 (twenty-four) hours in advance to avoid cancellation fees.
5. Rental Fees:
• Rental fees are calculated based on the duration of the rental period. Additional charges will apply for late returns, damages, or other incurred expenses.
• All daily rental charges exclude petrol. Scooters are delivered full and the hirer shall return the scooter full, inclusive of the appropriate 2- stroke to petrol ratios where applicable. If the scooter is not filled on return, the hirer shall be charged R100.00 (One Hundred Rand).
6. Security Deposit:
• The rental of each scooter is subject to a R4, 000.00(Four Thousand Rand) deposit, by credit card ONLY, which is fully refundable upon return of the scooter and helmet(s) in the same condition (fair wear and tear excluded) as received by the hirer.
• The hirer’s Credit Card must be present upon collection of the scooter, alternatively a local bank account detail provided for a refund a month after return of the scooter to protect RLC against fines received, if applicable.
• The scooter must be operated in accordance with all local traffic laws and regulations. RLC will not be held responsible for any fines or penalties incurred during the rental period.
• Whilst operating the scooter, the hirer agrees to not behave in any manner that would bring the name of RLC into disrepute.
• The scooter will not be used commercially or for financial gain and shall be used purely for personal transportation.
• Both the hirer and passenger (where applicable) shall, always, wear a helmet, which must be always clipped on and be firmly attached. Both the hirer and passenger (where applicable) agree to not operate the scooter under the influence of alcohol or any illegal or intoxicating substances of any nature.
• The scooter shall not be used off-road and must be driven on asphalt/tar. The scooter shall not be driven further than a 50km radius from RLC’s premises; or further north than Melkbosstrand or further east than Paarl or further South of Strand. In the event of the scooter breaking down, the hirer agrees to remain with the scooter, until RLC can arrange for collection of the scooter.
• Additional per km fees apply @ R2.00 for every extra km of more than 100km on a single day rental, R2.00 for every extra km over 150km on a two-day rental and R2.00 for every extra km of more than 75km per day on rentals of more than two days.
• All vehicles are highway approved.
• The renter/hirer confirms and warrants that all the information as requested by RLC, pertaining to the renting of the scooter, is true and correct and has a thorough knowledge of the applications of the scooter.
8. Overnight Parking;
The scooter must be parked off-street overnight with the steering locked for safe-keeping.
9. Maintenance and Repairs:
RLC maintains scooters in good working condition. However, the hirer will be responsible for promptly reporting any mechanical issues or damages. Unauthorized repairs will result in additional charges.
10. Liability Waiver:
• The hirer shall use the scooter entirely at his/her own risk and agrees that RLC, its employees, agents or associates shall not be responsible, liable, or accountable and shall be rendered blameless for any loss, injury or death sustained because of the rental and use of the scooter during the rental period, or any extension thereof. This is inclusive of whether the hirer elects to affect his/her tyre change him/herself as per the instruction given as per the rental agreement.
• RLC shall not be responsible and shall be rendered blameless for any loss or damage to goods of any nature left or transported on the scooter.
11. Insurance:
The hirer is encouraged to have his/her own insurance coverage for liability and personal injury protection.
12. Lost or Stolen Scooters:
• The hirer is responsible for the scooter and any accessories provided during the rental period.
• Lost or stolen scooters must be reported immediately to RLC.
• An incident of accident or theft is required, by law, to be reported to the SA Police Services (SAPS) within 24 hours. The hirer will be liable for the value of the complete loss should the correct police case number not be supplied to RLC within 72 hours.
• The hirer shall be responsible for any loss or damage incurred on the scooter, whether by accident or theft. This assessed loss shall be offset by any deposit held by RLC under this agreement, and the balance shall be payable to the hirer on return of the scooter.
1. R3, 500.00 (Three Thousand Five Hundred Rand) as the first amount payable (excess) should any damage to the scooter be incurred.
2. R5, 000.00 (Five Thousand Rand) is the first amount payable (excess) should the scooter be stolen.
13. Termination of Rental Agreement:
RLC reserves the right to terminate the rental agreement at any time should the terms and conditions outlined herein be violated.
14. The Hirer’s Information:
The renter/hirer confirms and warrants that all the information as requested by RLC, pertaining to the renting of the scooter, is true and correct and has a thorough knowledge of the applications of the scooter.
15. Governing Law:
This agreement is governed by the laws of South Africa. Any disputes arising from the rental agreement shall be resolved through arbitration in Cape Town.
16. Agreement Acknowledgement:
By signing this agreement or proceeding with the rental, the hirer acknowledges that he/she has read, understood, and agrees to abide by the terms and conditions outlined herein.
